DISCUSSION/BACKGROUND:

 

US 59 begins on the Crawford‑Shelby county line approximately ten miles south of the City of Denison, and travels generally northerly via the Cities of Denison and Schleswig to the Crawford‑Ida County line approximately three miles north of the City of Schleswig.

 

Due to an annexation to the City of Schleswig, the present description of US 59 in Crawford County should be deleted and the new description added should be officially included in the primary road system to reflect this change in corporate ­limits.

 

PROPOSAL/ACTION RECOMMENDATION:

 

It is recommended the commission approve deleting the present description of US 59 in Crawford County from the primary road system and approve including the attached new description of US 59 in the primary road system.

 

Locate US 59 and its extensions in Crawford County as follows:

I am attaching plats that show the portions of old US 59 and Iowa 141 that is to be abandoned to Crawford County due to the relocation of these roads under the above project.  The portion of US 59 and Iowa 141 that lies within the City of Denison will be taken over by the City of Denison under resolution signed and approved by the City of Denison and the Highway Commission on August 30, 1967.

 

The portion of these roads lying in the City of Denison will become the City's and their responsibility after traffic is placed on the new location.  A contract for 1 ½ inches for Asphaltic Concrete has been let to the Western Engineering Company to place a portion of the old road in Denison in good condition. The Koss Construction Company is moving on to this project at this time and we expect the pavement to be finished this fall.  When the project is paved and under traffic I will notify the County when these portions of the road will be returned to them, however, resolutions should be made up to that effect and traffic from these portions should be counted for one year beginning sometime after the new road is under traffic, however, we know by inspection that traffic will be very light on these sections of old road.

 

Will you please return six copies of the larger plat to this office, as we are unable to make these copies here?

This is to advise that the above project, which consists of a new four-lane pavement on Iowa 141 and US 59 northwest of Denison, has been completed and placed under traffic on November 8, 1967.

 

I am attaching a plat which shows that portions of the old Primary road will revert to the Secondary Road System one year after the date of the acceptance of this notice in accord with Section 313.2, Code of Iowa 958.

 

We are asking our Traffic and Highway Planning Department to start traffic counting on these sections of road as soon as possible. I am attaching two plats, one shows that portion of US 59 and Iowa 141 northwest of the Denison Corporation Line to be abandoned to the County.  The other plat shows that portion of old Iowa 141 that is to be abandoned to the County from the junction of US 59 and Iowa 141.

RESOLUTION

 

Resolution consenting to and approving the plans for the improvement of the extension of US 59 & Iowa 141 within the City of Denison, Iowa.

 

WHEREAS, it is proposed to improve by 3" A.C. resurfacing on the extension of US 59 & Iowa 141 within the City of Denison, Iowa in accordance with plans filed in the office of the Clerk of said City of Denison, Iowa as follows: from the WCL at Station 1877+50 southeasterly to Station 1910+60 and from Station 917+76 to Station 884+00 (near US 30)

Identified as Project Number P‑59‑0‑ (5) 30‑24, and

 

WHEREAS, the Council has informed itself as to the proposed improve­ment and has examined the plans thereof,

 

NOW, THEREFORE, be it resolved by the said Council of Denison, Iowa as follows:

 

1.       The Council hereby approves the plans for the said project and consents to the improvement in accordance with the plans.

 

2.       The Council will take such legal steps and prosecute to a con­clusion such legal action and/or proceedings as are now or may hereafter be required:

 

A.      To prevent the erection of any signboards:

 

(1)      on public property

(2)      on private property when they obstruct the view of any portion of the public highway or street or railroad track.

 

B.       To not close or obstruct the street either partially or completely; in any manner or for any purpose whatsoever except in those instances recited in Section 321.348, Code of Iowa, 1962.

 

C.      To remove or cause to be removed any other encroachment or obstruction within the rights‑of‑way of the streets or highways covered by the project and to prevent any future encroachment or obstructions therein.

3.       Within ninety (90) days after passing this resolution, the Council will, by ordinance, establish access control under the provisions of Chapter 306A, Code of 1962, prohibiting ingress or egress to, from, or across said facility to or from abutting lands, except at such designated points at which access may be permitted by the Iowa State Highway Commission, upon such terms and conditions as may be specified from time to time.  Access rights will not be destroyed except by purchase or appropriate condemnation proceedings thereof.  However, such access rights shall be subject to such regulations in the interest of public welfare and safety as the City and Iowa State Highway Commission may agree upon, providing that no additional access ways or change of use shall be permitted by the City without the consent and approval of the Iowa State Highway Commission. The Council will also authorize the Iowa State Highway Commission to acquire right‑of‑way and access rights by purchase or condemnation, as shown on the plans for Project Number   P-59‑0(5)30‑24     , and more specifically described as follows:

 

from the WCL station 1877+50 to Station 1910+60 and from Station 917+76 to Station 884+00.

The Council agrees that at the time relocated US 59 is open to traffic present US 59 and Iowa 141 from the WCL to US 30 shall become a part of the established street system of the city and future maintenance will be by local or pity expense.

 

The Council authorizes the Highway Commission to construct and preserve, within the limits of the right‑of‑way, such physical barriers as the Highway Commission deems necessary to prohibit or eliminate unlawful means of access to, or use of the Highway facility by pedestrian or vehicular traffic or for any other purpose.

4.       Within ninety (90) days after passing this resolution, the Coun­cil will pass and make effective ordinances prohibiting parking of any nature: from Station 1877+50 to Station 1910+60 and from Station 917+76 to Station 884+00.

Parking shall be prohibited on the minor street approaches for a distance of 35 ft. in advance of the stop signs and on the exit sides of the minor streets for a distance of 35 ft. beyond the right‑of-way line.

 

5.       Within sixty (60) days after completion of the project, the Iowa State Highway Commission shall determine, upon the basis of an engineering and traffic investigation, the reasonable and safe speed limits.

 

Present speed limits will be in effect until the investigation is completed and the appropriate signing is erected.

 

6.       Upon completion of the project, the Council agrees that

 

A.      Upon receipt from the Highway Commission of a list of driveways and entrances provided for access under the above improvement, specified as Project Number   P-59‑0(5)30‑24   said list will be recorded under a supplemental ordinance.

B.       Signing affecting directional traffic movements will be erected or changed only after approval is secured from the Highway Commission.

 

C.      Any changes in the physical features of the project will be authorized only after approval has been secured from the Highway Commission.

 

7.       Council will notify, by mail, all abutting property owners of the parking and access control restrictions that are being established on this section of Primary Road Extension.
